These Terms and Conditions ("Terms") govern your access to and use of the 1stLumi mobile application and related services (the "Service") operated by 1stLumi ("we," "us," or "our"). By downloading, installing, or using the app, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using 1stLumi, you confirm that:
- You are at least 16 years of age (or the age of digital consent in your jurisdiction)
- You have read and understood these Terms
- You agree to comply with all applicable local, national, and international laws
If you do not agree to these Terms, please do not use the Service.
2. Description of Service
1stLumi is a personal productivity and tracking application designed for parents and pet owners. The Service includes:
- Baby and pet profile management
- Growth tracking (weight, height, milestones)
- Health and medical record logging
- Diary and photo journaling
- Nursing and sleep tracking
- AI-powered chat assistance
- Schedule and reminder management
- iOS Home Screen widgets
3. User Accounts and Data
1stLumi operates primarily as a local, on-device application. You do not need to create an account to use the core features. All personal data you enter is stored on your device.
You are solely responsible for:
- The accuracy of data you enter into the app
- Maintaining backups of your data (we recommend enabling iCloud Backup)
- Any consequences of data loss due to device failure, app deletion, or updates
4. Subscriptions and Payments
4.1 Free Tier
1stLumi offers a free tier that includes limited features including up to 2 profiles and a limited daily AI chat quota.
4.2 Premium Subscription
1stLumi offers auto-renewable Premium subscriptions, granting unlimited profiles, unlimited AI chats, shareable PDF growth reports, iCloud sync, and all future Premium features:
- Monthly: $9.99 per month
- Yearly: $99.99 per year (save ~17%)
4.3 Lifetime Purchase
A one-time Lifetime purchase is available for $199.99, granting all Premium features permanently including unlimited AI chats.
4.4 Billing Terms
- All purchases are processed by Apple via the App Store and are subject to Apple's Terms of Service
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
- Prices may vary by country and are set in local currency by the App Store
- We do not offer refunds directly — refund requests must be made through Apple
4.5 Cancellation
You may cancel your subscription at any time through the App Store settings. Access to Premium features will remain active until the end of the current billing period.
5. AI Service
The AI features in 1stLumi are powered by third-party AI technology (OpenRouter / OpenAI, relayed via our proxy at 1stlumi.vercel.app). By using these features, you acknowledge:
- The AI does not provide medical advice. Information from the AI assistant is for informational and general guidance purposes only and should not replace professional medical advice from a licensed healthcare provider, veterinarian, or other qualified professional.
- AI responses may occasionally be inaccurate, incomplete, or outdated
- Always consult a qualified professional for medical, health, or safety decisions
- When you use AI features, certain data (the text you type, attached photos/video frames, your baby/pet profile, growth metrics, health records, and recent diary notes) is sent to our AI providers solely to generate a response. This data is not used to train models. See our Privacy Policy for full details.
6. Prohibited Uses
You agree not to use 1stLumi to:
- Violate any applicable laws or regulations
- Infringe the intellectual property rights of others
- Transmit any viruses, malware, or harmful code
- Attempt to reverse engineer, decompile, or disassemble the app
- Use the Service for any commercial purpose without our express written consent
- Harass, abuse, or harm any person
7. Intellectual Property
All content, design, code, graphics, and other materials in 1stLumi are the property of 1stLumi and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes.
You retain ownership of all content you create within the app (diary entries, photos, etc.).
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted or error-free
- Defects will be corrected
- The Service or servers are free of viruses or harmful components
- AI-generated content is accurate or reliable
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, 1STLUMI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR ANY OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless 1stLumi and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses arising from your use of the Service or violation of these Terms.
11. Modifications to the Service and Terms
We reserve the right to modify or discontinue the Service at any time with or without notice. We may also update these Terms periodically. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which 1stLumi operates, without regard to its conflict of law provisions.
